Deposit Policies


Deposit Agreement regarding the Administration of the Papers and Other Historical Materials

I hereby deposit, subject to the terms, conditions, and restrictions herein set forth, in the (hereinafter referred to as the Library) the papers and other historical materials as listed on the attached inventory (hereinafter referred to as the Collection). I certify that the above described is free and clear of any encumbrances, that I am the lawful owner of same and that I am making this deposit of my own free will.

In accordance with the conditions listed below, the Collection is deposited for the period to .

At the end of this time, this deposit may be renewed with the agreement of both parties or terminated at the discretion of either party. Under no circumstances shall a deposit agreement be in effect for more than five years without renewal or renegotiation of the agreement.


Ownership of the Collection

Title to the Collection shall remain in the possession of the Undersigned (hereinafter referred to as the Owner).

It is the responsibility of the Owner or his/her agent to notify the Library promptly and in writing if there is any change in ownership of the Collection or if there is a change in the identity or address of the Owner. The Library assumes no responsibility to search for an Owner who cannot be reached at the address of record.

In the event that this agreement remains in effect at the time of the dissolution of a corporate Owner, title to the Collection shall pass to the Library.

If the Library's efforts to return a Collection within one year following the termination of the deposit are unsuccessful, then the Owner shall be deemed to have made the Collection an unrestricted gift to the Library, and the Library is free to take any action with regard to the Collection that it sees fit. The Owner retains to him/herself all copyrights which he/she has in the Collection.


Transportation and Packing

The Owner certifies that the Collection to be deposited is in such condition as to withstand ordinary strains of packing, transportation, and handling by a shipper mutually acceptable to the Owner and the Library. A written report of the condition of materials prior to shipment must be sent by the Owner to the Library. Otherwise, it will be assumed that the Collection is received in the same condition as when leaving the Owner's possession.

Cost of packing and transportation to the Library including the cost of insurance coverage while in transit will be borne by the Library.



Care and Preservation

The Library will give to the Collection custodial care. Precautions will be taken to protect the Collection from fire, theft, mishandling, dirt and insects, and extremes of light, temperature and humidity while in the Library's custody. The Collection will not be cataloged or organized in any way beyond a basic inventory while it is on deposit.

It is understood by the Owner and the Library that all tangible objects are subject to gradual inherent deterioration for which neither party is responsible.


Exhibition

The Library retains the right to determine when, if, and for how long deposit Collections will be exhibited. The Ohio State University Libraries Exhibition Policy (attached to this agreement) will regulate the lending of deposit materials for exhibition. The Owner will be notified in writing at the address he/she has provided each time material from the Collection is loaned for exhibition.

The Owner is responsible for establishing the insurance value of materials loaned for exhibition. The costs for exhibition insurance are borne by the borrowing institution. P>

Unless otherwise notified in writing by the Owner, the Library or other users will give credit to the Owner as specified on the face of this agreement in any publications and on exhibition labels. Whether individual labels are provided is at the discretion of the Library or other exhibitor.


Insurance

The Owner exonerates the Library of liability for loss or other damage to the deposited Collection due to deterioration, fire, or other catastrophe, or any event or occurrence beyond the control of the library.


Access

The Collection will be administered in accordance with the established policies of The Ohio State University Libraries. The owner agrees that the Collection may be made available for study and research on an unrestricted basis subject to those restrictions which have been agreed upon by both the Owner and the Library and are specified on the attached page(s).

The Owner shall be permitted freely to examine any of the Collection during the regular working hours of the Library where they are preserved.


Additions to the Deposit

In the event that the Owner may from time to time hereafter deposit in the Library, subject to their acceptance by the Library, additional papers and other materials, all of the foregoing provisions of this agreement shall be applicable to such additional papers and materials. A description of the additional papers and materials so delivered shall be prepared by the Owner and attached hereto.


Return of Deposit Collections

Unless otherwise agreed in writing, this deposit terminates on the date specfied on the face of this agreement. Upon termination of the deposit, the Owner is on notice that a return or renewal must be effected.

The Collection will be returned only to the Owner of record or to a location mutually agreed upon in writing by the Library and the Owner of record. Should the Owner terminate the deposit agreement, he/she will reimburse the Library the full amount of packing and transportation costs. The method of transportation must be agreed upon by both parties.

In case of uncertainty, the Library reserves the right to require an Owner/claimant to establish title by proof satisfactory to the Library.

When the Collection is returned, the Library will send the Owner a receipt form. If this form is not signed and returned within thirty days after mailing, the Library will not be responsible for any damage or loss to the Collection.

Upon nonrenewal or termination of this deposit agreement, the Owner agrees to reimburse the Library for all costs associated with the care of the Collection during the term of the deposit. These costs include, but are not limited to, all packing and transportation expenses, inventory preparation, reboxing, reference and reproduction services, insurance, cleaning and fumigation, and storage fees.
